Terms of Sales

The following terms and conditions govern all purchases made on the usaroyalcheese.com website (the “Site”). By placing an order, you, the Customer, confirm that you have read, understood, and fully accept these terms without reservation. These terms constitute the entire agreement between you and Royalcheese regarding the sale of products.

Article 1 – Scope
These general terms of sale (GTC) apply exclusively to all sales concluded by Royalcheese via the usaroyalcheese.com Site. They prevail over any other document from the Customer, unless prior written and express acceptance by Royalcheese.

Article 2 – Products
The products offered for sale are those listed on the Site, within the limit of available stock. Royalcheese makes every effort to ensure the accuracy of product descriptions, photographs, and specifications. However, minor variations may occur. The photographs presented are non-contractual. The Customer is responsible for reviewing product characteristics before ordering.

Article 3 – Orders
To place an order, the Customer must select products, add them to the cart, and proceed through the checkout process, providing all necessary information. An order is only considered final after full payment has been received and confirmed by Royalcheese via an order confirmation email. Royalcheese reserves the right to refuse any order for legitimate reasons, particularly in case of unavailability, suspected fraud, or abnormal order.

Article 4 – Price
Prices are displayed on the Site in the selected currency. They are inclusive of all taxes but exclude any applicable shipping costs, which will be clearly indicated before finalizing the order. Royalcheese reserves the right to modify prices at any time, but products will be billed at the price in effect at the time the order is placed.

Article 5 – Payment
Payment is due immediately upon order confirmation. The Site uses a secure encrypted payment system. Payment can be made by major credit cards or other payment methods indicated at checkout. The transaction is final only upon actual collection of funds by Royalcheese.

Article 6 – Transfer of Ownership and Risk
Ownership of the products is transferred to the Customer only upon full payment of the price. The risk of loss or damage to the products is transferred to the Customer upon delivery to the carrier or upon collection by the Customer, as applicable.

Article 7 – Delivery
Delivery is made to the address provided by the Customer during the order process. The estimated delivery timeframe will be communicated during checkout and in the order confirmation. Royalcheese is not liable for delays caused by the carrier or force majeure events as defined by law.

Article 8 – Right of Withdrawal
In accordance with applicable distance selling regulations, the Customer has a legal right to withdraw from the contract without giving any reason within fourteen (14) days from the day of receipt of the products. To exercise this right, the Customer must notify Royalcheese of their decision to withdraw within this period using a clear statement. Products must be returned in their original, unused, and resalable condition, with all packaging intact. The direct cost of return shipping is the responsibility of the Customer. Upon receipt and verification of the returned goods, Royalcheese will process a refund using the same payment method used for the original transaction, without undue delay.

Article 9 – Warranty and Liability
All products sold by Royalcheese benefit from the legal warranty of conformity and the warranty against hidden defects, as provided by the law of the Customer’s country of residence. Royalcheese’s liability is strictly limited to the value of the order concerned and cannot be incurred for indirect damages. The products must be stored and handled according to the instructions provided, particularly regarding temperature.

Article 10 – Intellectual Property
All content on the usaroyalcheese.com Site (texts, graphics, logos, images, etc.) is the exclusive property of Royalcheese or its partners and is protected by intellectual property laws. Any reproduction or use without prior written authorization is strictly prohibited.

Article 11 – Personal Data
The personal data collected during the ordering process is necessary for processing and delivering orders. It is processed in accordance with our Privacy Policy, which is available on the Site and which the Customer is invited to consult.

Article 12 – Force Majeure
Royalcheese shall not be held liable for any failure or delay in performance resulting from circumstances constituting force majeure, as defined by law and jurisprudence.

Article 13 – Modifications
Royalcheese reserves the right to modify these Terms of Sales at any time. The applicable terms are those in effect on the date the order is placed.

Article 14 – Governing Law and Jurisdiction
These terms are governed by the laws of the country from which Royalcheese operates its online sales. Any dispute arising from their interpretation or execution shall, in the absence of an amicable settlement, fall under the exclusive jurisdiction of the competent courts of that country.
